Maqolada jazo institutining falsafiy va axloqiy asoslari konseptual jihatdan tahlil qilinadi. Jazo tushunchasi aniqlashtiriladi, uni oqlashning asosiy nazariyalari — retributiv, konsekvensialist, aralash va kommunikativ yondashuvlar qiyosiy o‘rganiladi hamda jazoni axloqan chegaralab turuvchi tamoyillar — qonuniylik, mutanosiblik, insonparvarlik va inson qadr-qimmati ko‘rib chiqiladi.
