HUQUQNING MADANIYATLARARO MOHIYATI: UNIVERSALLIK VA MILLIY-HUQUQIY O‘ZIGA XOSLIK

Huquq odatda davlat tomonidan belgilangan va majburiy kuch bilan ta’minlanadigan normalar tizimi sifatida tavsiflanadi. Biroq turli madaniy muhitlar o‘zaro kesishayotgan sharoitda bunday ta’rif huquqning real ijtimoiy hayotini to‘liq ochib bera olmaydi. Maqolada huquq madaniyatlararo fenomen sifatida tahlil qilinib, huquqiy norma, madaniy ma’no, mahalliy ijtimoiy amaliyot va universal huquqiy qadriyatlar o‘rtasidagi munosabat ko‘rib chiqiladi. Huquqiy plyuralizm, huquqiy transplant, “huquqiy irritant”, huquqlarni mahalliylashtirish va madaniy tarjima konsepsiyalari qiyosiy tahlil qilinadi. Universalizm va madaniy relativizm qarama-qarshiligini mutlaq ziddiyat sifatida qabul qilish o‘rniga, inson qadr-qimmati va asosiy huquqlarni cheklanmaydigan normativ minimum sifatida saqlagan holda, ularning ijtimoiy ifodasi madaniy muloqot orqali shakllanishi mumkinligi asoslanadi. Natijada huquqning madaniyatlararo amal qilishini izohlovchi kontekstual-dialogik model taklif etiladi. Model normativ yadro, madaniy kontekst, huquqiy tarjima, huquqlar filtri va dialogik verifikatsiya bosqichlarini birlashtiradi. O‘zbekiston huquqiy makoni misolida davlat huquqi, xalqaro standartlar va tarixiy-madaniy tajriba o‘rtasidagi munosabatlarni talqin qilish imkoniyatlari ko‘rsatiladi.
